Terms & Conditions

These Terms & Conditions govern your access to and use of the BE·IN·IT website and services, including the purchase, personalization, creation and delivery of BE·IN·IT Life Vision Books.

IMPORTANT BEFORE PUBLICATION

This is a working U.S.-focused agreement designed around the current BE·IN·IT service model. Highlighted operational and legal details must be finalized before launch, including the legal business name, pricing/revision rules, delivery practices, governing-law venue and business contact information. Final review by qualified counsel is recommended.

1. Agreement to These Terms

These Terms & Conditions (“Terms”) form a binding agreement between you and [INSERT LEGAL BUSINESS NAME / DBA INFORMATION], doing business as BE·IN·IT (“BE·IN·IT,” “we,” “us,” or “our”).

By accessing our website, placing an order, submitting information or photographs, or using a BE·IN·IT service, you agree to these Terms and any policies expressly incorporated into them, including our Privacy Policy, Refund & Cancellation Policy, and AI, Image & Photo Disclosure.

If you do not agree, do not purchase or use the services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase a personalized BE·IN·IT Life Vision Book. By ordering, you represent that the information you provide is accurate and that you have authority to submit all photographs, text and other content included with your order.

BE·IN·IT is currently designed primarily for customers in the United States. Availability in other jurisdictions may be limited.

3. The BE·IN·IT Service

BE·IN·IT creates personalized digital Life Vision Books. Depending on the product or package purchased, a Life Vision Book may incorporate selected life areas, customer-provided goals and vision information, customer photographs, AI-assisted personalized imagery, written vision statements, affirmations, music, editorial design and digital presentation.

Specific features, number of life areas, images, revisions, delivery format and other inclusions are determined by the package or offer displayed at the time of purchase. Promotional examples and sample books illustrate the nature of the service but do not guarantee that a customer's finished book will contain identical layouts, imagery, scenes, features or results.

4. Orders, Pricing and Payment

Prices, package inclusions and applicable charges will be displayed before checkout. You agree to pay the total amount presented at purchase, including applicable taxes and disclosed fees.

Payments are expected to be processed by [CONFIRM PAYMENT PROCESSOR]. Payment-card information may be handled directly by the payment processor under its own terms and privacy practices rather than stored by BE·IN·IT.

We may refuse, cancel or place an order on hold where reasonably necessary because of suspected fraud, unauthorized payment, prohibited content, inability to complete the requested personalization, technical limitations or material errors in pricing or product information. If we cancel a paid order before providing the purchased service, we will address the payment in accordance with applicable law and our Refund & Cancellation Policy.

5. Customer Responsibilities and Submitted Information

You are responsible for providing accurate, complete and reasonably clear information needed to create your Life Vision Book. Delays in submitting required information, photographs, approvals or responses may delay production and delivery.

You agree not to submit content that:

  • you do not own or have lawful permission to use;
  • violates another person's privacy, publicity, copyright, trademark or other rights;
  • is unlawful, fraudulent, threatening, exploitative or abusive;
  • requests deceptive impersonation, identity fraud or misleading representation of a real event;
  • contains malicious software or attempts to interfere with our systems; or
  • otherwise violates these Terms or applicable law.

We may decline or request modification of content that we reasonably believe creates legal, safety, privacy or technical concerns.

6. Photographs, Other People and Likeness Rights

When you upload a photograph, you represent that you own the photograph or have sufficient rights and permissions to provide it to us and authorize its use for your requested service.

If you provide a photograph or identifying information relating to another person, you represent that you have obtained any permission or authority reasonably necessary to submit that material and authorize its use in the requested personalized content.

Images of Minors

If you request inclusion of a minor, you represent that you are the minor's parent or legal guardian or otherwise possess the legal authority and necessary consent to provide the image and authorize the requested use. BE·IN·IT may impose additional requirements, request verification, restrict certain uses or decline an image request involving a minor.

Submitting a photograph does not transfer ownership of the original photograph to BE·IN·IT. You grant only the rights reasonably necessary for us and our service providers to perform the services described in these Terms and our related policies.

7. AI-Assisted Imagery and Generated Content

BE·IN·IT may use artificial intelligence and other image-processing technologies to create personalized visualizations from customer-provided photographs, descriptions and instructions. Additional details are provided in our AI, Image & Photo Disclosure.

You acknowledge that AI-generated content is probabilistic and may contain visual inaccuracies, unexpected details, artifacts or variations. We do not guarantee exact reproduction of facial features, body characteristics, clothing, objects, environments, relationships or other requested elements.

AI-generated scenes are creative visualizations. They are not photographs of events that actually occurred, predictions of future events, or guarantees that a depicted outcome will occur.

Where third-party AI or image-processing providers are used, processing may also be subject to applicable provider terms and privacy practices.

8. Production, Revisions and Delivery

Production begins after we receive the information, photographs and payment required for the purchased service. Estimated turnaround times are estimates unless we expressly state in writing that a particular delivery date is guaranteed.

Your purchased package will identify the revision allowance, if any. Revisions are intended to address eligible changes within the scope of the original order. A request that materially changes the original vision, replaces substantial portions of approved content, introduces new life areas or requires extensive new generation or design work may be treated as additional work and may require an additional fee.

Delivery is digital unless a product description expressly states otherwise. Customers are responsible for maintaining compatible internet access, devices and software needed to access web-based content.

9. Cancellations, Refunds and Custom Digital Products

BE·IN·IT Life Vision Books are personalized products created using customer-specific information, photographs and custom creative work. Cancellation and refund eligibility therefore may change once personalization or production begins.

The Refund & Cancellation Policy displayed at the time of purchase is incorporated into these Terms and governs cancellation, refund and eligible remedy requests. Nothing in these Terms limits a refund, cancellation or other remedy that cannot lawfully be waived under applicable consumer-protection law.

10. License to Customer Content

You retain whatever ownership rights you have in photographs, text and other original materials you submit (“Customer Content”). By submitting Customer Content, you grant BE·IN·IT and the service providers acting on our behalf a limited, non-exclusive license to host, reproduce, process, modify, transmit and otherwise use that Customer Content only as reasonably necessary to create, review, revise, deliver, secure and support the services you requested and to satisfy legitimate legal or recordkeeping obligations.

This license does not give BE·IN·IT permission to use your personal photographs or private Life Vision content in public advertising, social media, portfolios, testimonials or promotional examples without additional permission from you.

Any separate permission to feature a customer's story, testimonial, image or finished book publicly should be obtained through a distinct, voluntary authorization.

11. BE·IN·IT Intellectual Property and Your Finished Product

The BE·IN·IT name, branding, website, service design, templates, layouts, proprietary text, processes and other materials created or owned by BE·IN·IT are protected by applicable intellectual-property laws and remain the property of BE·IN·IT or its licensors.

Subject to payment in full and compliance with these Terms, you may use your delivered personalized Life Vision Book for your own personal, non-commercial use. You may display and enjoy the finished product for personal purposes and may share it privately with family and friends.

You may not resell, sublicense, commercially reproduce, white-label, distribute as a competing product, extract or repurpose BE·IN·IT templates or proprietary design elements, or use the service or delivered materials to create a competing commercial offering without our written permission.

Ownership and copyright status of individual AI-generated elements can depend on applicable law, the nature of human authorship and third-party provider terms. Nothing in these Terms promises copyright ownership in material that is not legally eligible for copyright protection.

12. Prohibited Uses

You may not use BE·IN·IT to violate law or another person's rights; create fraudulent or deceptive identity materials; harass, exploit or defame others; submit unlawful content; interfere with our systems; scrape or systematically extract our website or proprietary materials; reverse engineer protected service components; or use BE·IN·IT branding or content in a way that falsely suggests endorsement, affiliation or ownership.

13. Privacy

Our Privacy Policy explains how we collect, use, disclose and protect personal information, including customer photographs and Life Vision information. Our AI, Image & Photo Disclosure provides additional information about personalized imagery and customer photo processing.

By using our services, you acknowledge that personal information will be handled as described in the applicable privacy notices. Where applicable law requires consent for a particular processing activity, we will seek that consent separately rather than treating these Terms alone as consent.

14. Third-Party Services

Our services may rely on third-party providers for payment processing, website hosting, analytics, communications, AI/image processing, cloud storage, digital-book hosting, music or other functionality. Third-party services may be governed by their own terms and privacy policies.

We are not responsible for independent third-party websites or services outside our reasonable control. We may replace providers or modify technical components as our services evolve, subject to applicable contractual and legal obligations.

15. Visualization Is Not a Guarantee of Results

BE·IN·IT is a creative visualization and personal vision experience. It does not predict your future and does not guarantee financial, career, health, relationship, personal, spiritual or other outcomes.

Your Life Vision Book may help you make your goals and desired future more personally visible, but outcomes depend on many factors beyond the service, including your decisions, actions, circumstances and events outside anyone's control.

BE·IN·IT is not therapy, medical care, financial advice, investment advice, legal advice or a substitute for services from qualified professionals.

16. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DO NOT WARRANT THAT THE WEBSITE OR DIGITAL DELIVERY PLATFORM WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE OR COMPATIBLE WITH EVERY DEVICE, BROWSER OR THIRD-PARTY SERVICE.

WE DISCLAIM WARRANTIES TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED. NOTHING IN THESE TERMS EXCLUDES WARRANTIES, RIGHTS OR REMEDIES THAT APPLICABLE LAW DOES NOT PERMIT US TO EXCLUDE.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BE·IN·IT AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE WEBSITE OR SERVICES, INCLUDING LOST PROFITS, LOST OPPORTUNITIES OR LOSS OF DATA, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PURCHASED SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID BE·IN·IT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law and do not limit liability that cannot lawfully be excluded or limited.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless BE·IN·IT and its owners, officers, employees and agents from third-party claims, damages, liabilities and reasonable costs arising from your unlawful use of the services, your material breach of these Terms, or Customer Content you submit that infringes or violates another person's rights.

This section does not require you to indemnify BE·IN·IT for conduct for which indemnification cannot lawfully be required.

19. Suspension or Termination

We may suspend or terminate access to a service, decline submitted content or cancel an order where reasonably necessary because of a material violation of these Terms, unlawful or abusive activity, fraud, security concerns or risks to another person's rights. Any payment consequences will be handled under the Refund & Cancellation Policy and applicable law.

20. Governing Law and Disputes

These Terms are intended to be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent applicable consumer law requires otherwise.

Any court proceeding permitted under these Terms will be brought in a court of competent jurisdiction located in [CONFIRM COUNTY, TEXAS], unless applicable law gives you the right to bring the matter elsewhere.

No mandatory arbitration clause or class-action waiver has been inserted into this draft. Those provisions can materially affect legal rights and should not be casually copied from another company's terms. If BE·IN·IT later wants such provisions, they should be separately evaluated and drafted with counsel.

21. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will continue to the extent permitted by law. Our failure to enforce a provision does not waive our right to enforce it later.

You may not assign your rights or obligations under these Terms without our consent where consent is legally permitted to be required. We may assign these Terms in connection with a merger, reorganization, financing, acquisition or sale of all or part of our business, subject to applicable law.

These Terms, together with the policies and disclosures expressly incorporated into them and any specific written order terms, constitute the agreement between you and BE·IN·IT concerning the applicable services. If a specific order term expressly conflicts with these general Terms, the specific order term controls for that purchase to the extent of the conflict.

22. Changes to These Terms

We may update these Terms as our services, technology or legal obligations change. Updated Terms will be posted with a revised “Last Updated” date. When required by law, we will provide additional notice or obtain renewed agreement before materially changed terms apply to an existing customer relationship.

The Terms in effect when you place an order generally govern that transaction unless applicable law or an expressly accepted amendment provides otherwise.
